简介

Confusion and fear of liability surrounding copyright issues have reached alarming levels at colleges and universities across the country. In recent years alone, a federal court has assailed photocopying of book chapters at Kinkos Copies, universities have faced infringement accusations when they make computer software available to students and faculty, and media facilities have struggled with the possible and seemingly unknowable limits on using copyrighted videotapes. In the first large-scale study of its kinds, Kenneth D. Crews offers an enlightening explanation of copyright and the notoriously ambiguous concept of fair use as they affect and are affected by higher education. Crewss survey of copyright policies at ninety-eight American research universities reveals the various ways universities have responded to and how they could better manage the conflicting goals of copyright policies: avoiding infringements while promoting lawful uses that serve teaching and research. He explains in detail the background of copyright law and congressional guidelines affecting familiar uses of photocopies, videotapes, software, and reserve rooms. Ultimately, Crews concludes that most universities are overly conservative in their interpretation of copyright, often to the neglect of their own interests. He shows that universities do have choices when developing standards within the fair use law choices that do not involve unnecessary costs or obstacles and that some standards are better suited to serving the needs and goals of the academy. Copyright, Fair Use, and the Challenge for Universities provides administrators, instructors, lawyers, librarians, and educational leaders with incisive guidance on the principles that should underlie the construction of institutional copyright policy. Containing the verbatim texts of all the major model policy guidelines in use today, this book is an invaluable reference work for anyone looking for a broad understanding of copyrigh t law as it affects higher education. At the same time, it stands as a needed call to action for higher education to place academic needs at the center of its policy-making and to take full advantage of the rights allowed by law. - Dust jacket.
